State gets sued for withholding gun rights from those under 21

A lawsuit has been filed in federal court against the state of Minnesota for withholding Second Amendment rights for those individuals under 21.

The action, Worth v. Harrington, was brought by the Second Amendment Foundation on behalf of a number of plaintiffs including the Minnesota Gun Owners Caucus, Firearms Policy Coalition and three private citizens in the affected age group.

Defendants are John Harrington, commissioner of the Minnesota Department of Public Safety, plus three county sheriffs, Mille Lac County Sheriff Don Lorge, Douglas County Sheriff Troy Wolbersen and Washington County Sheriff Dan Starry, in their individual and official capacities.

Missouri Governor Will Sign Bill Nullifying Federal Gun Laws: Spokeswoman

Missouri Gov. Mike Parson will sign newly passed legislation that would ban state law enforcement agencies from enforcing new federal gun laws following proposed rulemaking from the Biden administration to regulate firearms with stabilizing braces.

According to Parson spokeswoman Kelli Jones, the Republican governor will sign the “Second Amendment Preservation Act,” which says that it is the duty of courts and law enforcement agencies in Missouri to protect the Second Amendment rights of citizens to keep and bear arms. It also declares federal laws that infringe on that right null.

“The Governor is aware of the legal implications of this bill, but also that, now more than ever, we must define a limited role for federal government in order to protect citizen’s rights guaranteed by the Second Amendment of the United States Constitution,” Jones said in a statement to news outlets on Thursday.

A large number of people who wish to disarm the population start with the premise “If there weren’t any guns”, as if, with extreme restrictions on owning and using guns, guns will eventually go away.

Under extreme legal restrictions, the number of guns has increased.
I recall a prominent talk show host in southern California, wailing about confiscated guns being sold: “But if that happens, we will never be rid of guns!” he cried as if his wish were plausible.

Guns are a 700 to 100-year-old technology. Guns can, and are, being made in homes and small shops around the world that are beyond state control.

Texas Is 25th State To Urge Supreme Court To Overturn New Jersey’s 11-Plus Gun Magazine Ban

Texas has joined a coalition of what is now 25 states urging the U.S. Supreme Court to repeal a New Jersey law banning the possession of firearms with magazines that hold more than 10 bullets, arguing the prohibition violates the Second Amendment and puts law-abiding citizens less able to defend themselves against dangerous criminals.

Texas Attorney General Ken Paxton announced in a statement that he had signed onto an amicus brief (pdf) which argues that allowing law-abiding citizens to carry firearms with 11-plus capacity magazines benefits public safety, counterbalances the threat of illegal gun violence, and helps “make our streets safer.”

“New Jersey’s law is a blatant violation of the Second Amendment, and its mere existence threatens the rights of law-abiding citizens. This law must be struck down,” Paxton said. “Criminalizing the possession of a magazine that is so commonly used leaves Americans defenseless and vulnerable, especially in high crime areas.”

Indiana gun permit law changes in July

COLUMBUS, Ind. – The Bartholomew County Sheriff’s Office reminds us that starting July 1, the lifetime license to carry a handgun in Indiana becomes fee exempt.

The five-year license is also fee exempt, but the five-year and lifetime license to carry a handgun may be applied for and held concurrently.

“We support this change in our gun permit law,” said Sheriff Matt Myers. “We do not believe that law-abiding Indiana citizens should have to pay a fee to practice their second amendment right.”

Ghost Guns and the Deeply American Tradition of Gun Privacy

Earlier this month, Sen. Richard Blumenthal (D-Conn) and Rep. David Cicilline (D-R.I.) introduced the Untraceable Firearms Act, a bill that targets “ghost guns,” or unregistered firearms without serial numbers.

Also called “kit guns” or “80% guns,” most are built at home from manufacturer-produced gun kits. Improvised weapons, also known as “pipe guns,” are another variation, and they’re constructed using 3D-printed parts or salvaged and repurposed materials.

The proposed law would place strict limitations on the obtainment and manufacture of these guns. For example, it would prohibit building or housing a homemade, 3D-printed firearm, as well as trading a kit gun with a friend. Punishments for an initial violation include fines and up to a year in prison. Subsequent violations can incur up to a five-year sentence.

Second Amendment sanctuaries facing first court test in Oregon

The first court test of whether local governments can ban police from enforcing certain gun laws is playing out in a rural Oregon county, one of a wave of U.S. counties declaring itself a Second Amendment sanctuary.

The measure that voters in the logging area of Columbia County narrowly approved last year forbids local officials from enforcing most federal and state gun laws and could impose thousands of dollars in fines on those who try.

NRA In Peril After Judge Rejects Bankruptcy Filing

The NRA was dealt a serious blow on Tuesday after a Texas judge tossed the gun rights organization's bid to declare bankruptcy, saying it was filed in "bad faith" in an effort to dodge litigation in New York.

Judge Harlin Hale tossed the case after New York Attorney General Letitia James and others questioned how legitimate the January 15th bankruptcy filing was, according to a report by Law 360.

The group filed for Chapter 11 bankruptcy after James filed a lawsuit to dissolve the NRA - alleging that the organization has abused its status as a nonprofit, along with corruption, and a "culture of self-dealing, mismanagement, and negligent oversight" fostered by longtime CEO Wayne LaPierre.

Arizona Governor Signs Law Designating Gun Stores As Essential Firms

Arizona Gov. Doug Ducey (R) has signed into law legislation that designates gun stores as essential businesses allowed to remain open during an emergency—a move that will further protect gun stores, manufacturers, and trade associations from lawsuits.

The new law, Senate Bill 1382, introduced by Republican Sen. Wendy Rogers, applies to any store selling guns or ammunition, or their components, and mirrors federal law that was passed on a bipartisan basis.

Ducey’s office said in a release that the measure will protect the Second Amendment rights of Arizonans by “safeguarding against frivolous lawsuits that have no connection to unlawful use of firearms.”

“With efforts currently underway in Washington to erode Second Amendment rights, Arizona is taking action to protect those rights,” Ducey said in a statement. “In Arizona, we’re safeguarding manufacturers, sellers, and trade associations.”

Texas Senate passes bill allowing permitless carry of firearms

The Texas Senate gave initial approval on a contentious bill to allow permitless carry of firearms in an 18-13 vote on Wednesday.

House Bill 1927 removes the licensing requirement for Texans to carry firearms if they are 21 or older “and not otherwise prohibited by state or federal law from possessing the firearm.”

“The premise of the bill is not about trying to keep guns out of the hands of criminals. This is about trying to reinstitute a constitutional right for law abiding citizens,” State Sen. Charles Schwertner, R-Georgetown, who is sponsoring the legislation in the Senate, said Wednesday.

“People who are prohibited from possessing a handgun will still be prohibited from possessing a handgun under this bill,” he said, noting that business owners and private property owners would still have the right to “exclude handguns on their property.”

On Wednesday night, President Joe Biden told a Congress that "white supremacy is terrorism," after claiming that US intelligence considers it "the most lethal terrorist threat to our homeland today."

U.S. Court Says Ghost Gun Blueprints Can Stay Online

The 9th U.S. Circuit Court of Appeals in San Francisco ruled this week that posting plans for so-called “ghost guns”—homemade firearms and firearm parts designed to route around gun regulations—is technically legal. The ruling, which affirmed the Trump-era removal of these gun and gun parts from the State Department’s Munitions List, means that the blueprints for these weapons can be sold for export without approval from the federal government.

Illinois judge rules FOID card 'unconstitutional'

An Illinois judge has ruled that Illinois' Firearm Owners Identification (FOID) card law is unconstitutional.

The 2017 case, The People of Illinois vs. Vivian Claudine Brown, comes after Vivian Brown was accused of possessing a firearm without a FOID card.

Brown argued that she "was a law-abiding person charged with possessing an otherwise lawful firearm without a FOID card solely within the confines of her home and that requiring her to go through the FOID card process unconstitutionally infringed upon her fundamental right of self-defense in this 'most private of areas.'"

White County Judge T. Scott Webb agreed.

The circuit court of White County dismissed the charge, finding that, as applied to the facts of the case, requiring a FOID card was unconstitutional under the second amendment to the United States Constitution (U.S. Const., amend. II) and article I, section 22, of the Illinois Constitution of 1970

'Eye-popping numbers': Chicago sues Indiana gun store tied to 850 firearms recovered from crime scenes

CHICAGO – The city of Chicago filed a lawsuit Monday against a northern Indiana gun store it claims is one of the main sources of illicit firearms for the city's criminal market.

Westforth Sports, Inc. in Gary, Indiana, has "engaged in a pattern of illegal sales that has resulted in the flow of hundreds, if not thousands, of illegal firearms into the City of Chicago," according to the lawsuit filed in the Circuit Court of Cook County.

First 2nd Amendment SCOTUS Case In Way Too Long:

The Supreme Court announced Monday it will hear a major new gun control case next term, accepting a National Rifle Association-backed challenge that requests that the to declare there is a constitutional right to carry a weapon outside the home.

The court will hear the challenge to a New York gun control law in the term that begins in October. It is considering a law that requires those who seek a permit to carry a concealed weapon show a special requirement for self-defense.

The rule in question is similar to laws in Maryland, Massachusetts and other states that the court has declined to review. The Supreme Court had turned down a review of this issue in June, before Justice Ruth Bader Ginsburg’s death.

Supreme Court Agrees To Hear Major Second Amendment Case

The Supreme Court has agreed to take up a major NRA-backed case to determine how much the Second Amendment applies outside of the home.

The case involves an appeal by a New York-based gun-rights group and two individuals who claim their rights have been infringed upon by a state law restricting the ability of residents to carry concealed handguns in public.

According to an Axios report, New York’s current handgun licensing laws restricts those carrying in public to those who can “demonstrate a special need for self-protection distinguishable from that of the general community or of persons engaged in the same profession.”

The National Rifle Association has backed the appeal.

The New York State Rifle & Pistol Association, the group involved in the appeal, would like to see the Supreme Court clarify the rights of the individual.

Gov. Abbott supports legislation to make Texas a Second Amendment sanctuary state

In response to Resident Biden’s continued assault on Americans’ gun rights, Texas Gov. Greg Abbott issued a proclamation via Twitter that calls on his state’s legislature to pass a bill designating the Lone Star State as a Second Amendment “sanctuary state.”

“Biden is threatening our 2nd Amendment rights,” Abbott wrote. “He just announced a new liberal power grab to take away our guns. We will NOT allow this in TX. It’s time to get legislation making TX a 2nd Amendment Sanctuary State passed and to my desk for signing.”

Abbott went on to commend Arizona Gov. Doug Ducey for signing legislation in his state on April 6 that bans law enforcement from enforcing any federal gun control laws that infringe upon the Second Amendment.

Facebook Bans Your Gun Ads But Spends Millions On Zuckerberg Security

The same Facebook social media platform that bans your gun ads spent over $23 million on security for Mark Zuckerberg in 2020.

The Daily Mail reports Facebook spent “more than $13.4 million on personal security” for Zuckerberg, plus another $10 million in the form of a “pre-tax allowance…for his family’s private security.”

The spending represented a $3 million increase over security costs for 2019.

Armed Civilians Guard Minnesota Stores as Rioting and Looting Erupts for a Second Night

Looting and rioting flared for a second night around Minneapolis on Monday, with rioters calling their attacks on stores and police a response to the death of Daunte Wright.

Wright, a 20-year-old African-American male, was killed Sunday after being pulled over by Brooklyn Center police.

On Monday, Brooklyn Center Police Chief Tim Gannon said that the officer who shot Wright appeared to have thought she was firing a Taser at Wright when she was actually firing her service weapon.

That explanation did little to bring calm to the streets of the Minneapolis suburb, nor did a curfew that rioters violated as they attacked a Brooklyn Center police station.

Rioters erupted in a wild outbreak of looting Sunday night, and on Monday attacked more stores — including a Dollar Tree store that was later set on fire — according to the Minneapolis Star-Tribune.

Some stores were reportedly protected by armed civilians, whose presence alone was enough to deter the crowds.

Will Supremes Unleash Biden Red Flag Gun Raids?

President Joe Biden launched his first attack on the Second Amendment this week, making clear his intent to radically curtail Americans’ legal rights to own firearms. The White House boasted that Biden was nominating a “fierce” advocate of gun control, David Chipman, to be chief of the Alcohol Tobacco and Firearms (ATF) agency. Chipman, a former ATF agent, is so dedicated to banning assault weapons that he brazenly lied last year about the 1993 federal assault at Waco, claiming that the Branch Davidians shot down two National Guard helicopters that were assaulting their home. Chipman, a Phillips Exeter Academy graduate who carries a concealed weapon himself, was an ATF case agent at the 1994 trial of the Branch Davidian survivors so he had no excuse for tossing out this anti-gun fairy tale.

There were so many lies in Vice President Kamala Harris’ and President Joe Biden’s presentations on guns Thursday that it is hard to know where to start. One thing is certain, though: The media fact-checkers won’t question their claims.

Here are just a few of the false ones:

The background check system “has kept more than 3 million firearms out of the hands of dangerous people.”
Since the Brady background checks began in 1994, there have been 3.5 million initial denials. However, it is one thing to stop a felon from buying a gun. It is quite another to stop a law-abiding citizen from buying a gun just because his or her name is similar to a felon’s. In 2017, for example, there were 112,000 initial denials for supposedly attempted prohibited purchases, but just 12 federal prosecutions by June 2018. The reason is that these weren’t real cases.

West Virginia governor signs law eliminating sales tax on guns and giving tax break to gun manufacturers

West Virginia Gov. Jim Justice signed a bill removing the sales tax on gun and ammunition purchases across his state.

Justice, a Republican, signed H.R. 2499 into law, removing the sales tax on guns and ammunition while also providing tax credits for gun manufacturers, according to Bearing Arms.

Republican Del. Gary Howell, the bill’s primary sponsor, applauded the governor’s decision and said the new law will make his state a stronghold for the Second Amendment.

“In 90 days West Virginia will become the single best place for small arms and small arms ammunition manufacturers to locate,” Howell posted on Facebook. “I would welcome all small arms and ammunition manufacturers to move to Mineral County, West Virginia.”

Arizona's Governor has signed a new law that would halt federal gun laws that would break the Second Amendment.

The HB-2111 legislation was signed into law Tuesday by Arizona Republican Gov. Doug Ducey, securing rights of gun owners are guarded against potential overreaching gun laws attempted by President Joe Biden's administration.

The law attempts to prevent police and sheriffs from enforcing new federal gun laws, which critics maintain will weaken the rule of law and discourage law enforcement officers from enforcing federal gun laws to defend the public. Critics further say it is an unconstitutional bill that will cost taxpayers to defend in court.

The first time the gun owner hears of the proceeding is when law enforcement knocks on the door — ready to raid their home. -- They are not there because there is probable cause to suspect the gun owner has committed a crime, as the Constitution would seem to require. Rather, the new Red Flag standard seeks to make subjective determinations on whether the gun owner represents some “threat” to society.
